What the law says
Bingo feels like the gentlest thing on this list, but legally it’s a straightforward game of chance. US federal law even uses that phrase, calling it “the game of chance commonly known as bingo” in the law on tribal gaming. You pay, the draw is random and there’s a prize, so it passes all three parts of the test.
It’s legal in most places because lawmakers carved out room for it. In the US that usually means charity bingo. California only allows it where a city or county has approved it, and the games must be run by unpaid members of the charity, with prizes capped at $500 a game. Texas licenses charity bingo through its Bingo Enabling Act. Utah’s constitution bans games of chance outright, so there’s no legal bingo there at all.
The UK treats bingo as licensed gambling. Bingo halls and online bingo sites need a Gambling Commission licence, and running a game for money without one is a criminal offence. There are exceptions for small games, such as pub bingo with stakes of up to £5 per person where all the money goes back out as prizes.
Why it doesn’t feel like gambling
Bingo is social, the stakes are usually small, and in the US the money often goes to a church or charity. That’s all fair, and it’s why the law treats it gently. None of it changes how the game works, though. Charity bingo is still gambling, just a kind the law permits.
What it means for you
A bingo night with friends or a church game is about as low-risk as gambling gets. Online bingo is a different experience, with faster games and no natural end to the evening, so treat it the way you’d treat any online casino.
Questions people also ask
Is church or charity bingo legal?
Usually yes, if the group follows its state's rules. California needs a local ordinance, unpaid volunteers and caps prizes at $500 a game. Texas needs a state licence. Utah doesn't allow bingo at all.
Is free bingo with prizes gambling?
Generally no. Without a payment to play, one of the three parts of the test is missing.
Can you run bingo in a UK pub?
Yes, without a licence, as long as stakes are no more than £5 per person per game and all the stakes go back out as prizes.
